Quick Answer

Does FDACS-16055 need to be notarized?

Yes on the reviewed form. FDACS-16055, Application for Change in Agency Partner, Corporate Officer, or LLC Member (05/18), includes Section IX Personal Inquiry Waiver and Notarization Statement and tells the applicant not to sign until in the presence of a Notary Public. Rule 5N-1.142 requires the agency to submit the change within five working days. Dollar amounts printed on the FDACS instructions are FDACS fees, not iRemoteNotary session fees.

What agency changes this form addresses

Use FDACS-16055 when a licensed agency changes a partner, corporate officer, or LLC member. The new partner, officer, or member named on the application is the Section IX signer.

Not every agency change uses the same supporting documents. Rule 5N-1.142 and the form list three attachment options. Pick the path that matches your transaction—do not assume every filing needs a resignation letter.

Section IX Personal Inquiry Waiver and Notarization Statement

Section IX is labeled Personal Inquiry Waiver and Notarization Statement. It is not the same instrument as standalone FDACS-16009, and it is not the perjury-style Personal Inquiry Waiver and Verification section used in many license application packets.

The reviewed form says: do not sign the application until you are in the presence of the Notary Public who will notarize your application. It prints a STATE OF FLORIDA jurat block.

Supporting documents — resignation letter is one option

In addition to FDACS-16055, one of the following must accompany the application under the rule and form instructions:

  • A copy of the minutes from the board meeting at which the change took effect
  • A notarized letter of resignation of the previous partner, officer, or member
  • Amended Articles of Incorporation filed with the Florida Department of State

Only the resignation-letter path calls for a notarized letter among those three options. Minutes or amended articles may apply instead. If you need the resignation letter notarized, send that unsigned letter for review as well.

Five working days

Rule 5N-1.142 requires the agency, within five working days of the change, to submit FDACS-16055 and one of the permitted supporting documents. Plan the notary session early enough to meet that filing clock.

FDACS fees versus session fees

Amounts printed on FDACS-16055 instructions (including application and fingerprint-processing figures such as $50 and $42) are fees payable to FDACS. They are not iRemoteNotary session fees.

A domestic session with one signer and one notarization is $25. Each additional notarization is $15. An additional signer is $10. A witness is $15. An international session coordination fee of $25 applies when a signer is outside the United States. An international session commonly starts at $50 for one signer and one notarization.

Online notarization and agency coordination

Section IX is a traditional notarial act on the reviewed form. Remote online notarization may be available when identity and platform rules are met. Eligibility for remote notarization and recipient acceptance are separate questions. The Division of Licensing decides completeness and licensure.

Multi-entity operators and legal-support teams can reuse the same request path. See security and recovery agencies and legal-support teams. Parent index: which FDACS forms include a notarial section.
