Guides for contractors, subcontractors, property owners, and construction professionals on notarizing eligible construction documents online.
Contractors, subcontractors, property owners, and construction professionals can notarize many eligible construction documents online — including lien waivers, notices of commencement, and contractor affidavits.
Learn how eligible construction lien waivers may be notarized online and what contractors, subcontractors, and property owners should confirm before signing.
Final payment affidavits, lien releases, and related construction payment documents may be eligible for online notarization when the signer, document, recipient, and recording requirements allow remote online notarization.
Florida's statutory Notice of Commencement form includes a notarial certificate and expressly provides for physical presence or online notarization. Recording, posting, and permit requirements remain separate from the notarial act.
Conditional and unconditional lien waivers do not share one nationwide notarization rule. State forms, payment stage, and receiving-party instructions determine whether notarization is required.
Some states require a construction claim of lien to be sworn, verified, acknowledged, or notarized. Others use a verification procedure without a separate acknowledgment. The controlling state statute and recording authority determine the required form.
Preliminary notices and notices to owner are generally notice documents used to identify potential lien claimants. Many official forms require a signature and timely delivery but do not contain a notarial certificate.
A progress payment affidavit requires notarization when the controlling form, contract, agency, lender, or payment administrator requires a sworn certification—not on every construction project.
An affidavit of payment to subcontractors or suppliers requires notarization when the controlling form, contract, agency, lender, or closeout procedure requires a sworn statement—not on every construction project.
Under AIA's standard G702 instructions, the contractor signs and notarizes G702 and submits it with G703. G703 ordinarily does not receive separate notarization. Confirm the edition, contract, and architect instructions.
An Affidavit of No Outstanding Liens commonly contains a sworn statement and notarial certificate when the signer declares that project-related lien claims, debts, or payment obligations have been resolved or identifies remaining exceptions.
Owner-builder affidavits and permit authorization forms are controlled by state law and the local building department. Some agencies require a notarized owner signature; others require personal appearance before permit staff.
Construction closeout is a package, not a single document. Some closeout records require a notarial act when they contain affidavits or sworn statements; others ordinarily function without notarization.
After a Notice of Commencement is recorded, an amended notice, new notice, local filing affidavit, or termination may be required. Each lifecycle instrument has its own purpose, notarization requirements, and separate recording or permit steps.
The signer must have authority to act for the person or entity named in the document. A notary verifies identity and performs the notarial act; the notary generally does not decide whether the signer can bind the entity.
Change-of-contractor affidavits are local permitting forms. Many Florida building departments require notarized signatures, but procedures vary—and notarization does not transfer the permit or replace Florida's separate Notice of Commencement recording requirement when the contractor changes.
