Terms of Service

iRemoteNotary — National remote online notarization engine. Headquartered in Florida. Not a law firm.

These Terms of Service are effective January 1, 2026, and apply to all users of the iRemoteNotary website, booking flows, and remote online notarization (RON) sessions coordinated through our platform.

1. We are not attorneys

iRemoteNotary is not a law firm and does not provide legal advice, document preparation, or opinions on the validity, enforceability, or sufficiency of any document. If you need legal guidance, consult a qualified attorney licensed in your jurisdiction.

2. Acceptance of terms

By accessing or using our services, you agree to these Terms and our policies referenced herein, including the Notary Disclaimer, RON Disclosure, and Accessibility Statement. If you do not agree, do not use the platform.

3. Nature of services

iRemoteNotary operates a technology and orchestration layer that connects signers with commissioned notaries authorized to perform remote online notarizations where permitted by law. Notaries are independent; their acts are governed by the laws and commissioning rules of their jurisdiction.

We do not guarantee that any third party (county recorder, government agency, lender, title company, or foreign authority) will accept an electronic or remotely notarized document. You are responsible for confirming acceptance with the intended recipient before booking.

4. Florida law and national operations

iRemoteNotary is headquartered in Florida. For disputes arising from these Terms or your use of the platform (subject to mandatory consumer protection rules in your jurisdiction), you agree that the laws of the State of Florida, without regard to conflict-of-law principles, govern the interpretation of these Terms, except where preempted by federal law or where local law cannot validly be waived.

Where RON is performed by a Florida-commissioned notary, that act is conducted in accordance with Florida’s remote online notarization framework and administrative rules as in effect at the time of the session. For notaries commissioned in other states, the applicable state’s RON and notary statutes apply to the notarial act itself.

5. Identity verification (KBA) and eligibility

Statute-compliant RON typically requires identity proofing and credential analysis (often referred to as KBA and credential review). You must provide accurate information and complete all required steps. Failure to verify identity, technical failures outside our reasonable control, or refusal to consent to required recordings may result in session cancellation. Fees, if any, are handled according to the pricing terms presented at checkout.

6. Electronic records and communications

You consent to receive notices and records electronically, including session confirmations, receipts, and links to completed documents where applicable. You are responsible for maintaining access to a valid email address and secure storage of delivered files.

7. Limitation of liability

To the fullest extent permitted by law, iRemoteNotary and its affiliates are not liable for indirect, incidental, special, or consequential damages, or for any loss arising from rejected documents, recording errors by third parties, or your reliance on non-legal information. Our aggregate liability for direct damages relating to the platform is limited to the fees you paid to iRemoteNotary for the specific transaction giving rise to the claim, unless otherwise required by law.

8. Changes

We may update these Terms to reflect legal, security, or operational changes. The “Effective” date at the top of this page will be revised when material updates are published. Continued use after posting constitutes acceptance unless applicable law requires additional consent.
