Quick Answer

Does Federal Rule of Evidence 902(11) require a notary?

No. Rule 902(11) is a certification by the custodian or another qualified person that a domestic record meets Rule 803(6)(A) through (C), with advance notice to the other party. The rule text does not require a notary.

A form that prints a jurat is a custodian affidavit, not this certification. A notarial copy attestation and an official-record certification are different acts again.

Testimony or certification

Rule 803(6)(D), in the December 1, 2025 pamphlet, allows the regularly conducted activity foundation to be shown by testimony of the custodian or another qualified witness, or by a certification that complies with Rule 902(11) or (12) or with a statute permitting certification.

Rule 902(11) covers the original or a copy of a domestic record. Before the trial or hearing, the proponent must give reasonable written notice and make the record and certification available. Rule 902(12) covers foreign records in a civil case. The certification must be signed so that a false certification would be a crime in the country where it is signed. That foreign signature rule is not a Florida online jurat.

What this certification is not

An official public record may be proved by a certification under Rules 902(4) and 1005. That is not a private-company custodian affidavit. A signer’s true-copy affidavit is the signer’s statement. Florida notarial copy attestation under §117.05(12) is the notary’s act, and it is explained on the business-copy guide and the LLC operating-agreement guide.

If the subpoena or the state statute in the file prints a jurat, review that page. Do not treat Rule 902(11) as permission to ignore it, and do not treat the jurat as what Rule 902(11) requires.

An Evidence Rule 801 amendment scheduled for December 1, 2026 does not change Rules 803(6), 902(11), or 902(12). A proposed amendment to Rule 902(1) about tribal public records is not current law and is not Rule 902(11).

iRemoteNotary does not decide whether the records are admissible. There is no records portal and no volume price.

No express recipient-acceptance source was identified in the official materials reviewed. Remote online notarization is performed under the law of the online notary's commissioning state. When the commission is a Florida commission, Florida Statutes §§117.209, 117.215, and 117.265 describe the online notarial act. They do not say a court, agency, or company accepts the result.
