Can a Loan Modification Be Notarized Online?

RON for a loan modification is a three-part question: lawful notarial act, servicer/investor permission, and recorder/title acceptance when recording is required—not a guarantee from Florida RON law alone.

Quick Answer

Can a loan modification be notarized online?

Sometimes. A loan modification document may be remotely notarized when (1) the notarial act is legally permitted where the notary performs it, (2) the lender, mortgage servicer, and investor permit that electronic or RON workflow for your file, (3) any title requirements are satisfied, and (4) if the document must be recorded, the applicable recording office accepts the remotely notarized instrument.

Do not treat Fannie Mae policy permission, or the fact that a U.S. online notary may lawfully perform RON, as automatic approval for every servicer package.

iRemoteNotary does not negotiate, arrange, approve, recommend, or obtain loan modifications. We perform notarial acts and signing support for completed documents prepared or authorized by a lender, mortgage servicer, attorney, title company, or other authorized party.

The Three-Part Approval Model for Modification RON

Ask these questions before booking—not after the session.

First: is the notarial act lawful for a remote online notarization under the online notary’s commissioning-state law and the certificate presented?

Second: does the mortgage servicer (and investor, where applicable) permit electronic signatures and remote notarization for this modification file?

Third: if the agreement must be recorded, does the recording jurisdiction accept a remotely notarized instrument, and do any title conditions apply?

Fannie Mae Policy Example (Not Universal Approval)

Current Fannie Mae Selling Guide A2-4.1-03 states that Fannie accepts delivery and servicing of loans with electronic documents—including security instruments or mortgage loan modification agreements—that have been electronically notarized in person or remotely using real-time two-way audio/video, when the notarization is legally valid under the laws of the state where it is performed and complies with applicable UETA and ESIGN requirements.

Fannie’s Flex Modification guidance also states that electronic documents, signatures, and notarizations for Flex Modifications are acceptable when the electronic record complies with Fannie’s requirements.

Fannie policy can permit RON. It does not mean your particular servicer has approved iRemoteNotary for your package, that wet-ink alternatives may be ignored, or that every county will record the result. A lender may not require a borrower to use remote notarization and must have other notary options available upon request under Fannie’s RON standards.

Recording and Security-Instrument Amendments

Current Fannie processing procedures for Flex Modifications require recordation when necessary to ensure the modified mortgage retains its first lien position and enforceability, or when the agreement includes assignment of leases and rents provisions. When recordation is required, Fannie’s RON standards also require that the county recorder accept the remotely notarized document.

If the remotely notarized document is a security instrument or an amendment to a security instrument, additional title-related requirements may apply under Fannie’s guide. Confirm with the servicer and any title provider named in the package.

Wet-Sign, Electronic Workflow, Identity, and Return

Servicers may require wet-ink originals, hybrid packages, electronic originals, scanbacks, overnight return labels, or custodian delivery. Use only the final prepared document. Complete identity verification as required for the session. Do not invent seals on pages that do not call for a notarial act.

Frequently asked questions

Can Fannie Mae loan modifications use RON?

Fannie Mae policy can permit electronic notarization and remote online notarization of mortgage loan modification agreements when its requirements and applicable law are met. You still must confirm that your servicer’s workflow and any recording/title requirements allow that path for your file.

Does Fannie approval mean my servicer approved this session?

No. Investor policy permission is not the same as transaction-specific servicer approval.

What if the modification must be recorded?

Recorder acceptance of a remotely notarized instrument matters. Ask the servicer which recording path applies before booking RON.

Can iRemoteNotary get my loan modified online?

No. iRemoteNotary does not negotiate, arrange, approve, recommend, or obtain loan modifications. We perform notarial acts and signing support for completed documents prepared or authorized by a lender, mortgage servicer, attorney, title company, or other authorized party.
