Who may apply, evidence age bands, same-item re-amendment, date-of-birth changes, and name changes are governed by 901 KAR 5:070. Forms with whiteout or strikethroughs are rejected. Notarization does not approve the amendment. Confirm remote online notarization acceptance before booking.

Kentucky's Office of Vital Statistics publishes VS-2J as the Birth Amendment Affidavit. The face of the current CHFS PDF identifies revision 11.24.2025. Administrative regulation 901 KAR 5:070 sets who may apply, when evidence is required, and when a court order is mandatory.

Under 901 KAR 5:070 Section 8, application to amend a Kentucky birth certificate is made by the parent or legal guardian if the registrant is under 18; by the registrant if 18 or over; or by the individual responsible for filing the birth certificate. On VS-2J, a custodian or guardian must present a valid certified permanent custody or guardianship court order, and a registrant signing must be 18 or show emancipation by certified court order or certified marriage certificate.
Section 6 states that other amendments (beyond the special name and date-of-birth rules) shall be supported by an affidavit or by documentary evidence established: five years prior for registrants 18+; three years prior for ages 7–17; or one year prior for ages 3–6.
| Registrant age | Documentary evidence established |
|---|---|
| 18 or older | At least five years before the amendment date |
| Ages 7–17 | At least three years before the amendment date |
| Ages 3–6 | At least one year before the amendment date |
Section 5: date of birth may be changed only with a court order from a court of competent jurisdiction, unless proof shows the error occurred upon the original filing by the individual responsible for filing the birth certificate.
Section 4: a court-ordered name change is generally required to change the name on the birth certificate, unless documentation shows the name was incorrectly recorded at registration and Section 8 applicant rules are met.
Section 7: once an item has been amended, that same item cannot be amended again except upon a court order.
Section 3 separately allows the State Registrar to amend obvious errors, letter transpositions of common knowledge, or omissions within one year after the date of birth upon observation, query, or request of parents, legal guardian, or the filer.
If you have the current unsigned VS-2J Rev. 11.24.2025, understand that notarization does not approve the amendment, and you will confirm recipient acceptance of remote online notarization, start a secure session with a commissioned U.S. online notary.
VS-2J Section 22 instructs that the notary must be commissioned in the United States unless the certification is completed in a foreign country by a notarizing officer from a U.S. Embassy or Consulate abroad. If certification is made by an out-of-state or foreign notary, the document must have a raised seal or inked stamp of the notary.
Forms with whiteout or strikethroughs will not be accepted. Alterations invalidate the submission path described on the form instructions.
